1. Overview
Welcome to Rivet (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Rivet’s website, SMS services, and related products (collectively, the “Service”).
By using Rivet, you agree to these Terms. If you do not agree, please do not use the Service.
2. The Rivet Service
Rivet provides call-handling and messaging tools that help small businesses manage missed calls and customer communications.
The Service includes:
Missed-call capture and automatic text replies
Voicemail recording and optional transcription
Message forwarding and conversation delivery to your chosen number or device
Rivet does not replace your phone carrier; it operates alongside your existing phone system.
3. Eligibility
To use Rivet, you must:
Be at least 18 years old (or the legal age in your jurisdiction)
Use the Service for lawful business purposes
Have the authority to bind your organization to these Terms
4. Free Trial and Subscriptions
4.1 Free Trial
New users may begin with a 30-day free trial, no credit card required.
The trial is intended for evaluation and may include limited features or usage caps.
4.2 Subscription and Billing
After your trial, continued use requires a paid subscription.
Billing is handled securely through Stripe or another authorized payment processor.
By subscribing, you authorize Rivet to charge your chosen payment method each billing cycle until you cancel.
4.3 Cancellation
You may cancel your subscription at any time from your account or by contacting us at billing@getrivet.ca.
Cancellations take effect at the end of the current billing period; no prorated refunds are provided unless required by law.
5. Acceptable Use
You agree to use Rivet responsibly and in compliance with applicable laws, including Canadian Anti-Spam Legislation (CASL) and, where relevant, U.S. TCPA regulations.
You may not use Rivet to:
Send unsolicited or fraudulent messages
Harass, threaten, or deceive others
Infringe on third-party rights
Attempt to reverse engineer, resell, or misuse the Service
Violation of this section may result in suspension or termination of your account.
6. Data, Privacy, and Messages
By using Rivet, you consent to our Privacy Policy.
You retain ownership of the content of your communications.
Rivet acts as a processor/transmission agent only.
To provide the Service, we work with trusted third-party providers such as:
Twilio – call and text message routing
Stripe – payment processing
Hosting partners for secure data storage and uptime monitoring
Message and call data are processed and stored securely in accordance with our Privacy Policy.
7. Service Availability
Rivet strives for continuous uptime, but temporary interruptions may occur due to maintenance, upgrades, or network issues outside our control (e.g., carrier outages).
We are not liable for loss of business or revenue due to such interruptions.
8. Limitation of Liability
To the maximum extent permitted by law:
Rivet is provided “as is” and “as available.”
We make no warranties, express or implied, regarding uninterrupted service or specific business results.
In no event shall Rivet’s total liability exceed the amount paid by you in the 3 months preceding the event giving rise to a claim.
You are responsible for ensuring compliance with all laws applicable to your communications and customer data.
9. Termination
We may suspend or terminate your access if:
You violate these Terms or applicable laws
Your account is inactive for extended periods
We are required to do so by law or network partners
Upon termination, your right to use the Service ceases immediately. Data may be retained for record keeping or legal purposes as described in the Privacy Policy.
10. Intellectual Property
All intellectual property related to Rivet (software, branding, website design, text, logos, and trade dress) is owned by Rivet or its licensors.
You may not copy, modify, or distribute Rivet’s materials without prior written consent.
11. Indemnification
You agree to indemnify and hold harmless Rivet, its employees, and partners from any claims, damages, or expenses arising from:
Your use or misuse of the Service
Your violation of these Terms or applicable laws
Content or messages transmitted through your Rivet account
12. Changes to These Terms
We may modify these Terms at any time. Updates will be posted on our website with a new “Last updated” date. Continued use after an update constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and applicable laws of Canada, without regard to conflict of law principles.
Disputes will be resolved in the courts located in Ontario, Canada.
